Consent to the Processing and Transfer of Personal Data During Recruitment

By clicking the “I Consent” button (the “Consent Button”), I, as the data subject, give my explicit consent to Prequel Inc., a company incorporated under the laws of the State of Delaware, United States, having registered number 7506376 and principal place of business at 15 Palm Avenue, Miami Beach, FL 33139, United States, acting as the data controller, to the processing and transfer of my personal data in accordance with (i) Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”) and, where applicable, (ii) applicable U.S. data protection laws, including the California Consumer Privacy Act as amended (“CCPA”), freely and unambiguously under the following conditions:
1. Purpose of data processing
I understand and agree that the data controller will process my personal data outlined in Section 2 of this consent form for the purposes of:

  • conducting the recruitment process; and
  • entering into and performing a potential employment contract or service agreement with one of the Prequel Inc. entities.
2. Scope of data processed by the data controller
For the purposes mentioned in Section 1 above, the data controller will process the following data based on my consent according to Article 6(1)(a) of the GDPR, as applicable:

  • My name, address, email address, telephone number and other contact information;
  • My resume or CV, cover letter, previous and/or relevant work experience or other experience, education, and any other information I provide in support of an application and/or the application and recruitment process;
  • Information from interviews, if any;
  • Details of the type of employment I am or may be looking for, current and/or desired salary and other terms relating to compensation and benefits, willingness to relocate, or other job preferences;
  • Details of how I heard about the position I am applying for;
  • Any sensitive and/or demographic information processed during the application or recruitment process, such as gender, information about my citizenship and/or nationality, medical or health information, and/or my racial or ethnic origin (only where permitted by law and where relevant to the position or required by law);
  • Reference information and/or information received from background checks (where applicable), including information provided by third parties;
  • Information relating to any previous applications I may have made to Prequel and/or any previous employment history with Prequel;
  • Information from publicly available sources, including online sources, that the controller believes is relevant to my application or a potential future application (e.g., my LinkedIn profile, referrals, recruitment agencies/search firms, if any);
  • Information related to any assessment I may take as part of the interview or screening process.
3. Legal basis for the processing
The legal basis for the processing of personal data is set out in Article 6(1)(a) of the GDPR (consent). I understand that the data controller will process the data taking into full account the interests and fundamental rights of the data subject.
4. Transfer to third countries (including the United States)
As the data controller is a company incorporated under the laws of the State of Delaware, United States, having its principal place of business at 15 Palm Avenue, Miami Beach, FL 33139, United States, and with access to my personal data limited to the HR personnel of Prequel Inc. I hereby consent to the transfer of my personal data outlined in Section 2 to the territory of the United States and, where relevant, to other countries outside the European Economic Area for the purposes provided in this consent form.

I understand that such countries may have data protection laws that are different from those of the European Union/European Economic Area. The data controller will implement appropriate safeguards for such transfers, such as the European Commission’s Standard Contractual Clauses or other legally recognised transfer mechanisms, and/or rely on my explicit consent for the transfer where permitted by Article 49 of the GDPR, as further described in the data controller’s Privacy Policy.
5. Data retention - how long is the data stored?
I understand that data on job applicants is stored for a maximum period of one (1) year and is used exclusively in case other vacancies open within that one-year period for which my earlier job application could be relevant. Following the one-year period, or earlier if I so request (where applicable under GDPR or other laws), all personal data will be permanently deleted or irreversibly anonymised by Prequel Inc., unless a longer retention period is required or permitted by applicable law.
6. Declaration and information on my rights
I declare that I have read and understood the data controller’s Privacy Policy available at prequel.app, and I agree that the Privacy Policy forms an integral part of this document.

I declare that I have been properly informed by the data controller, in accordance with Article 13 of the GDPR, about the processing of my personal data and about my rights under the GDPR. I understand that, in particular, I have the following rights:

  • the right of access to my personal data;
  • the right to request rectification of inaccurate personal data;
  • the right to request erasure of my personal data (“right to be forgotten”);
  • the right to request restriction of processing;
  • the right to data portability, that is, to receive my personal data in a structured, commonly used and machine-readable format and to transmit those data to another controller;
  • the right to object at any time to the processing of my personal data, including, where applicable, profiling based on such data;
  • where applicable, the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning me or similarly significantly affects me;
  • the right to withdraw my consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal;
  • the right to lodge a complaint with a supervisory authority.

If I am a resident of California, I understand that I may have additional rights under the CCPA, including (to the extent applicable to recruitment data):

  • the right to request information about the categories and specific pieces of personal information collected, used and disclosed;
  • the right to request deletion of my personal information, subject to legal exceptions;
  • the right to correct inaccurate personal information; and
  • the right to be free from unlawful discriminatory treatment for exercising my rights.

To the extent required by the CCPA, I understand that Prequel Inc. does not “sell” or “share” (as those terms are defined in the CCPA) my recruitment-related personal information.

I understand that I may exercise these rights at any time without any detrimental consequences for my application, by contacting the data controller using the contact details indicated in this document or in the Privacy Policy.

In light of the above, by clicking the Consent Button, I give my explicit consent to the processing of my personal data by Prequel Inc. for the recruitment purposes described in this document.

This consent is given of my own free will, with full understanding of the purpose and all other relevant details of data processing and transfer, and may be revoked at any time, without affecting the lawfulness of processing based on my consent before its withdrawal.

In accordance with Article 17 of the GDPR and other applicable laws, I am aware that I can decide at any time to withdraw my present consent to the collection, processing, storage and use of my personal data by sending an email to [email protected], or by sending a letter to the address of the data controller as stated above.
